Wedding Photography & Videography Agreement
Below is our contract for you to read over and sign. It sets out all the important information on how we will work together, what you can expect time-wise, payment terms, and other important logistical details.
The contract is designed to protect both of us from any misunderstandings. Think of it as much your document as ours. If there is anything you are unclear about, do not hesitate to fire over your questions. It is super important that you feel happy and confident before you sign the dotted line (or tick the box in this digital world!), so take your time and let us know if anything is unclear.
CONTRACTOR'S RESPONSIBILITIES
Taylor Burton Weddings ("Contractor") hereby agrees to perform photography and/or videography services for the Client at the Event specified above in a professional, workmanlike manner according to the prevailing standards in the industry ("Services"). Contractor may employ one or more assistants. The Contractor is not responsible for the impact on the final product of any interference caused by guests or other vendors at the Event. Contractor will make every effort to obtain, but cannot guarantee delivery of, any specific footage or photographs requested by the Client due to lack of control over the Event, its participants, weather, and any venue or officiant restrictions.
If the Contractor is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the Event, the Contractor reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the Event. In such an event, the Contractor shall not be obligated to refund any fees paid by the Client.
ENTIRE AGREEMENT
This agreement contains the entire understanding between Taylor Burton Weddings and the Client as to the photography and/or videography services outlined in this Agreement. All previous negotiations, understandings, warranties, or commitments concerning the services are merged in and superseded by this Agreement and are of no effect.
RESERVATION
Upon the Client’s signature, Taylor Burton Weddings will reserve the time and date of the event and will not make other reservations for that time and date. For this reason, the Reservation Deposit (40% of the total package price) is non-refundable, even if the date is changed or the event is cancelled for any reason, including but not limited to acts of God, fire, and/or extreme weather. The Reservation Deposit is to be paid at the time of signing the contract and is applied toward the contracted cost.
CANCELLATION
In the event that the Client cancels the services outlined in this Agreement before the event takes place, the reservation deposit will be forfeited. Taylor Burton Weddings agrees to refund all additional paid money (less expenditures for which receipts will be provided) to the Client.
COVID-19 POLICY
In the event of rescheduling or cancelling due to COVID-19 lockdowns or restrictions, rescheduled wedding dates must be booked again within 18 months of the original wedding date and dates are subject to the Contractor’s availability. The Client will not incur any rescheduling fees, price increases, or loss of payments already made should both parties mutually agree on a new date.
EXPENSES INCURRED
All reasonable travel and accommodation expenses incurred by Taylor Burton Weddings in connection with the photography and/or videography services are inclusive of the total package cost.
LIMIT OF LIABILITY
If Taylor Burton Weddings cannot perform this Agreement due to personal injury, illness, or any other cause beyond its control, a refund will be issued. If there is no replacement available, all monies paid shall be returned to the Client. The Contractor has working methods in place to prevent loss or damage to the Client’s footage, photographs, and audio recordings but cannot guarantee that media from the event will not be lost, stolen, or destroyed. The Client agrees that the Contractor’s full and complete responsibility and liability is limited to the return of all payments received for the event.
EVENT SCHEDULE
The Client agrees to confirm the schedule no later than one week prior to the event. Notification of any changes in schedule or location must be made in a timely manner and confirmation must be obtained from Taylor Burton Weddings by the Client.
EVENT GUIDE
The Client will be responsible for identifying people/objects of whom/which specific footage or photographs are desired. Taylor Burton Weddings will not be held accountable for not capturing desired people if there is no one to assist in identifying or gathering people.
EVENT MEAL
Taylor Burton Weddings and any second shooter (if present) will be provided with a guest meal.
MODEL RELEASE
The Client grants Taylor Burton Weddings the irrevocable and unrestricted right to use and publish footage and photographs of the Client or in which the Client may be included for editorial, trade, advertising, and promotional purposes.
DELIVERABLES
Delivery of raw footage or unedited images is not included, only final edits. The Contractor retains the right to edit the media and omit any clips, photographs, or audio. It is understood that the Contractor will not deliver every clip or image taken. The Client agrees to abide by the Contractor’s editing decisions.
Final media produced by the Contractor are protected by Australian Copyright Law (all rights reserved). Upon final payment, the Client is allowed to display the resulting video/s and photos for personal use. The Client may not alter or reproduce media in any manner without prior written permission from Taylor Burton Weddings.
RESTRICTIONS, ENVIRONMENT & FILMING/PHOTOGRAPHY
Restrictions imposed by others (church, other vendors, guests, reception, etc.), safety constraints, weather, and poor lighting conditions can affect the quality and extent of coverage possible. Taylor Burton Weddings will not be responsible for scenes missed due to these restrictions.
Although every effort will be made to capture all important moments, the Contractor cannot place an unconditional guarantee on the final product. The Client acknowledges that lighting conditions impact quality, and adverse environments may affect the final result.
MUSIC LICENSING (VIDEOGRAPHY ONLY)
All music used within the final video/s will obtain licensing to comply with copyright laws. Requested tracks may not always be used due to licensing restrictions.
DELIVERY OF PROJECT
Taylor Burton Weddings will use all reasonable skill and effort to create the project and deliver the completed media within 2 months of the wedding date. Failure to deliver by this date is not a breach of this agreement. Any delays due to Client actions, illness, or circumstances beyond the Contractor’s control shall alter the delivery date. The Contractor will make a reasonable effort to notify the Client of any delays.
SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and all other provisions shall remain in full force and effect.
PAYMENT
The Client agrees to pay Taylor Burton Weddings as follows:
a) Upon signing the Agreement, the Client shall pay a non-refundable reservation deposit of 40% of the total package cost.
b) Upon handover of the final deliverables, the Client shall pay the remaining 60% balance.
